US military jury finds Marine not guilty of all charges in hazing trial of fellow corporal

KANEOHE BAY, Hawaii - A military jury has decided a Marine is not guilty of hazing a fellow lance corporal who killed himself in Afghanistan.

The panel of three officers and five enlisted Marines found Lance Cpl. Carlos Orozco III not guilty Friday in a court-martial at Marine Corps Base Hawaii.

He was acquitted of charges involving the assault, cruel treatment and humiliation of Lance Cpl. Harry Lew, of California. Lew was a nephew of Democratic Rep. Judy Chu.

Lew fatally shot himself with his machine-gun at their Afghanistan patrol base last April.

Orozco is the last of three Marines to be court-martialed for the alleged hazing of Lew. Another lance corporal last month pleaded guilty to assault. A jury found their squad leader not guilty of humiliating and demeaning Lew.

Senators meet Cuba leader over detained US man

Updated 1:38 p.m. ET: HAVANA, Cuba -- A senior U.S. senator met with imprisoned American Alan Gross and discussed the man's case in a long sit-down with Cuban President Raul Castro, but said Friday that he doesn't expect Gross to be released any time soon.

Sen. Patrick Leahy, a Democrat from Vermont, said he saw Gross on Thursday afternoon at a Havana military prison. He and Sen. Richard Shelby, a Republican from Alabama, later met for 2 1/2 hours with Castro and offered to take Gross back to the United States on their plane.

"You can imagine how far that went," Leahy said in a phone interview Friday with The Associated Press. He added that "we have a long way to go" to win Gross's release.

Judy Gross, whose husband Alan has been in a jail in Cuba for two years, talks about his conviction and the struggle to bring him home.

The 62-year-old Maryland native is serving a 15-year jail term for spiriting satellite and other communications equipment onto the island while on a USAID-funded democracy-building program. Cuba considers the programs an attempt to destabilize the government, and Gross was convicted of crimes against the state, not espionage.

The Gross affair has chilled relations between the U.S. and Cuba and short-circuited any chance of rapprochement since President Barack Obama took office.

The Gross family wants Castro to pardon him on humanitarian grounds because his mother and adult daughter both have cancer, a call backed by the Obama administration, which insists Gross is innocent.

Leahy said Castro agreed that Gross "was no spy." Gross spoke virtually no Spanish and traveled to Cuba five times under his own name before his arrest in December 2009.

The talks with Castro and the senators was the first high-level meeting between the Cold War enemies since former President Jimmy Carter dined with Castro during a visit to the island in April 2010. Leahy said the late-night meeting was cordial and open.

The meeting took place as the Cuban diplomatic mission in Washington announced plans to host what it called the "1st National Encounter" with Cubans living in the United States. The meeting will bring together Cuban-Americans "who have respectful links to their country," in order to discuss "the normalization of relations" between Cuba and the exile community in the United States, the statement said.

Leahy?said Castro brought up the case of five Cuban agents sentenced to long jail terms in the United States, including one who was released last year but has not been allowed to return to Cuba while he serves out three years probation.

Leahy said Castro never explicitly linked Gross' fate with that of the agents, who were jailed in 1998, but "he made it very clear that while we may be concerned for Mr. Gross and have humanitarian reasons to be, they are very concerned about the five (agents) and have humanitarian and family reasons too."

While the agents' case is largely forgotten in the United States, it remains a cause celebre in Cuba, where the government hails the "Cuban Five" as heroes who were only trying to detect and prevent violent attacks against their country by exile groups.

Cuban officials have stopped short of linking the cases, but have said no one should expect the island to free the 62-year-old American in a "unilateral gesture."

Gross's legal appeals have been exhausted, but his family has asked Castro to consider a pardon on humanitarian grounds. Gross, who was portly when arrested in December 2009, has lost about 100 pounds and is now rail thin. His elderly mother and adult daughter are both battling cancer.

Leahy said Gross appeared in reasonably good spirits during the visit, but that he also indicated his two years of detention had taken a toll on his health.

"He obviously wants to leave. He feels that his health has been endangered," Leahy said, adding that he snapped several pictures of Gross to bring back to his wife, Judy.

Cuban state-run media carried images of the meeting between Castro and the senators, though they gave no details of what was discussed. Cuban media said Cuban Foreign Minister Bruno Rodriguez was also present.

The senators are part of an American congressional delegation touring Cuba, Haiti and Colombia. The other members of the delegation, all Democrats, were Sens. Christopher Coons of Delaware and Kent Conrad of North Dakota and Reps. Peter Welch of Vermont and Xavier Becerra of California.

Over time, we hope to delve into all aspects of a crucial decision ? not just managing the costs but sorting out benefit packages, weighing alternatives, and dealing with insurers and brokers. Along the way, we hope to get a better understanding of how the 2010 health-care legislation will, or won?t, affect small businesses.

Today we meet Ann Gish, who designs high-end bed linens from offices in Manhattan. As we proceed with this series, we?d like to hear from you. THE OWNER Ann Gish, 63.

THE COMPANY Ann Gish Inc. designs and distributes luxury bed and table linens and pillows, which are sold at Bergdorf Goodman, NeimanMarcus.com and boutiques nationwide. In 2011, the company opened its own store in Manhattan. Excluding Ms. Gish and her husband, Ann Gish Inc. employs 10 people in the United States.

WHAT THE COMPANY PAYS The company bears the entire premium cost for its workforce, $472 a month per employee. It?provides individual coverage only, but Ms. Gish said that most of her employees are either unmarried or have spouses who get insurance through their jobs. One sales manager, however, has a self-employed husband with a pre-existing condition and a child. Ms. Gish pays the employee?s premiums, and the employee pays the insurance for the rest of her family ? an additional $1,300 a month. ?She used her agent, we used our agent, and this was the best we could do,? Ms. Gish said. ?If she could find a better deal, we?d give her the $500.? Ms. Gish said she is giving serious thought to reducing the share of employee premiums that her company pays: ?I want to see what happens business-wise over the next year, and I want to see what happens when the health care reform kicks in.?

THE PLAN Ann Gish offers preferred provider organization coverage, a form of managed care that favors doctors and hospitals that are in-network. One aspect of the plan that galls Ms. Gish is that doctors must seek permission from the insurer before prescribing some treatments. However, Ms. Gish said, the plan is ?non-gated,? meaning that employees don?t need permission from their primary doctor to see a specialist.

THE INSURER Currently, it?s Aetna; before that, it was Oxford. ?We?ve changed either every year or every two years,? Ms. Gish said, ?because they take away the policy that you have, and they give you a new one that?s more money and generally fewer benefits.? In recent years, premiums have bounced around, Ms. Gish said: $422 in 2009, $479 in 2010, back down to $443 last year, and now back up again. Meanwhile, she said, this year employees face slightly higher co-payments and much steeper deductibles.

THE HEADACHE Pounding and relentless. Even simple tasks, she said, like adding or removing employees from the rolls, are complicated: ?My husband, who does all of the C.F.O. stuff, has spent hours and hours and hours on this. And I spend a couple days a year on it. And I?m not stupid. I?ve started a successful business.?

WHAT DIFFERENCE THE OVERHAUL HAS MADE SO FAR None. She looked into the health care tax credit available to small businesses under the law but found that the average wages her company pays exceed the law?s $50,000 threshold for the credit.

WHAT SHE WANTS FROM REFORM Simplification. Health insurance, Ms. Gish said, ?should be put together in a way that any idiot could understand.? Though Ms. Gish has occasionally read press accounts of how the Affordable Care Act will change insurance, she concedes that she still does not know what to expect. ?I figure when 2014? comes, I?ll have to learn it,? she said. ?But since I feel pretty powerless about doing anything, and since it could all change before then, what?s the point in trying to sink your teeth into it now??

Republicans take Solyndra message to Obama (AP)

WASHINGTON ? If you want a window into how outside Republican groups are likely to assail President Barack Obama's record this year, look no further than how the GOP is lambasting the administration's handling of solar company Solyndra.

Republicans have used Obama's ties to the bankrupt California manufacturer to argue that he plays the same political games that have consumed Washington for generations ? and has failed to live up to promises to change the nation's capital. It's the message GOP-leaning outside groups are promoting in advertising campaigns in states critical to the Democrat's re-election race.

"Tell President Obama American workers aren't pawns in your political games," says one ad run by Americans for Prosperity, a conservative group linked to billionaire oil industry executives Charles and David Koch.

Such ads were among the warning signs the Obama campaign saw before it decided to encourage its donors to financially support a Democratic-leaning super PAC, Priorities USA. The announcement came as outside groups supporting Republican Mitt Romney heaped criticism on rival Newt Gingrich before the Iowa caucuses and in early primary states, a preview of what could confront Obama once the GOP primaries are settled.

For Republicans hoping to unseat Obama, Solyndra has become a code word for his handling of the economy.

Obama visited the company two years ago, lauding it for "leading the way toward a brighter and more prosperous future." It received more than $500 million in federal loans, becoming the first alternative energy company to receive a loan guarantee under a stimulus-law program the Obama administration highlighted as a way to foster green jobs.

But in September 2011, the company went belly up, resulting in the loss of 1,100 jobs and turning the little-known firm into a campaign catch-phrase for Republicans challenging Obama. Republicans have sought to highlight the connection between Obama fundraisers and the company, arguing that the president used government policies to benefit campaign supporters ? and, thus, was no different than the typical Washington politician he promised not to become.

Steve Spinner, an Energy Department official, has raised at least $500,000 for Obama's campaign while Steve Westly, a venture capitalist who was an unpaid adviser to the Energy Department, has raised between $200,000 and $500,000. Emails released by congressional investigators show Spinner was actively involved in the Solyndra loan, despite pledging to step aside because his wife's law firm represented the company. Westly tried to warn Obama against the May 2010 trip to Solyndra's Fremont, Calif., headquarters but the president made the trip anyway.

One of Solyndra's investors was the foundation of George Kaiser, an Oklahoma billionaire who has supported Obama. Kaiser has said he did not play a role in helping Solyndra receive the loan, but emails show he discussed the solar company with the White House at least once and directed business associates on how to approach the administration to help Solyndra grapple with its financial problems.

Obama and Energy Secretary Steven Chu have said the loan program was intended to spark investment in renewable energy programs that otherwise would not qualify for a private loan. They say officials knew from the start that some investments would fail.

A report released last week by a former Treasury official said the government could lose nearly $3 billion on green energy loans ? far less than the $10 billion Congress set aside for the high-risk program. The White House asked a former official to conduct the review in response to investigations by congressional Republicans into the Solyndra

As the GOP presidential race continues, the Republican message aims squarely at undermining Obama's case on rebuilding the economy as well undercutting his perceived strengths among voters on character issues such as honesty and integrity.

"All of the sudden the companies that end up getting the grants are those who happen to be well politically connected," said Whit Ayres, a Republican pollster, explaining the GOP's Solyndra message.

Celinda Lake, a Democratic pollster, said the Republican spots were going after Obama's integrity but also allowed the re-election campaign to deflect the issue and turn the attention to the oil industry's support for Republicans.

Obama's campaign responded with its own ad ? the first of his re-election campaign.

It told voters the president was under attack by "secretive oil billionaires" and defended his record on energy. The ad ? at a cost of $2.5 million ? ran in the same six states where Americans for Prosperity aired its ad.

Most notably, Obama's team used the spot to rebut the charges of political machinations, calling the president's record on ethics "unprecedented" and claiming that Obama "kept a campaign promise to toughen ethics rules."

American Crossroads, a super PAC connected to Republican strategist Karl Rove, weighed in recently as well. It paid about $500,000 to air a similar spot that called Solyndra a "big government fiasco." It raised the issue of whether Obama supporters benefited from billions in taxpayer money while laid-off workers were "forgotten ? typical Washington."

The Koch brothers have said they intend to remain active this election cycle.

The Jan 14th issue of The Economist published a truly excellent article on disruptive innovation and change management. We?ve long known of Kodak?s troubles. But few mainstream newspapers or magazines have written such an insightful piece as this.

Kodak was, as the Economist writes, the Google of its days. Highly inventive, highly innovative and successfully rolling out new, sustaining innovations. This lead to a 90% market share in film (can you spell market leader) and 85% of camera sales in the US. Well into the 1990?s, Kodak was rated as one of the world?s most valuable brands.

?By 1976 Kodak accounted for 90% of film and 85% of camera sales in America. Until the 1990s it was regularly rated one of the world?s five most valuable brands?. In fact, In 1996, Kodak was ranked the world?s fourth most-valuable brand behind Disney, Coca-Cola and McDonald?s?.

Then digital hit. At least, that?s what most people seem to believe.
But in reality, Kodak had been sitting on the Digital Camera and digital technology since 1973. Only they were afraid of the consequences?

Kodak engineer, Steven Sasson is credited with inventing the first digital camera in 1975 (first prototypes in 1973). Leslie Carter Died of Prescription Drug Overdose, Police Believe

Though the results of a toxicology test could take several more weeks, an incident report on the death of Leslie Carter
 reveals that the sister of Backstreet Boys member Nick Carter was under the influence of several prescription drugs at the time of her death.

According to ABC News, details from the report compiled by officials who responded to the 911 call from Leslie Carter's family reveal that three drugs were found near her body: one to treat symptoms of schizophrenia and bipolar disorder, a muscle relaxant and an anxiety disorder medication.

Leslie's stepmother, Ginger Carter, told authorities that the onetime singer had a "long history of mental illness and was on medication for her depression" and that she seemed depressed on the morning of January 30. In addition, she fell down in the shower on that morning, after which Ginger helped Leslie lie down in a bed and checked in on her periodically. Later that day, Ginger realized that Leslie, 25, was not breathing and Robert Carter, Leslie's father, tried to perform CPR on her before they called 911.

The incident report also claimed that Ginger Carter appeared to be under the influence of drugs and/or alcohol when authorities responded, exhibiting "slurred speech, pinpoint pupils, glassy eyes and [she] kept falling asleep." Ginger told officials that she had taken "five to six" pills for depression, which was more than her usual dose, "because of Leslie passing away."

In the wake of his sister's death, Nick Carter had promised to keep working and on Thursday night he was back on stage at New York's Irving Plaza for a solo show. In his first public appearance since Leslie's death, Carter put on his standard high-energy show, including original songs from his recent album and covers of U2's "With or Without You" and Rod Stewart's "Do Ya Think I'm Sexy."

E! Online reported that he also took it down a notch when he pulled out an acoustic guitar and spoke for the first time in public about his Leslie. "I never thought I'd ever have to, but I'd like to dedicate this song to my sister," he said with a hitch in his voice. He then performed his song "Falling Down," his eyes welling up with tears as he sang.
